These Auction Conditions establish the regulations and principles that govern the bidding and auction process on Gavel. By participating in any auction on Gavel, you commit to complying with these conditions.
Auction Listings
Gavel provides a platform for listing various items on behalf of sellers. As part of our commitment to maintaining the highest standards, Gavel employs a rigorous authentication procedure to verify the accuracy and authenticity of the information provided by the seller. We take all necessary measures to ensure the authenticity of items listed on our platform, fostering a trustworthy marketplace. Gavel reserves the right to review, approve, or reject submitted auction listings in accordance with our policies.
Item Inspection Procedure
- Seller Contact: If you're a seller and wish to list your item on Gavel, please contact our team.
- Shipping to Gavel: Once your item is approved for listing, you will be required to ship the item to Gavel.
- Authentication and Inspection: Gavel will send the item to an authorized third-party for authentication and inspection. A fee for this service may apply, as outlined in the Fees and Payments section.
- Listing Approval: After successful authentication and inspection, your item will be listed on our platform for auction.
- Auction Process: Your item will be made available for bidding, and you will be notified of the auction's progress.
- Completion of Sale: If your item is sold, Gavel will deduct any applicable fees from the total selling price and proceed with the sale.
Item Conditions
- Unworn: Watches categorized as unworn are brand new and have never been worn. They should come in pristine condition with no signs of wear or use.
- Very good: Watches categorized as very good may have been worn briefly but show minimal signs of wear, if any. They should still be in excellent condition with no significant scratches, dents, or other damages.
- Good: Watches categorized as good may show some signs of wear and use, such as light scratches or minor dents. However, they should still be fully functional and in decent condition overall.
- Fair: Watches categorized as fair may show noticeable signs of wear and use, such as scratches, dents, or discoloration. They may also require some maintenance or repairs to be fully functional. These watches typically have more visible wear compared to those categorized as good or very good.
Bidding Process
- Placing Bids: Users may place bids on items listed on Gavel. Each bid constitutes a binding offer to purchase the item at the bid price if the bidder wins the auction.
- Bid Increments: Gavel may establish bid increment rules to ensure fair bidding practices.
- Winning Bid: The highest valid bid at the auction's conclusion wins the item. In the event of a tie, the earliest placed bid takes precedence.
- Proxy Bidding: Gavel may offer proxy bidding, where the system automatically increases a bidder's bid incrementally to maintain their lead up to their specified maximum.
Auction Extension (Sniping)
To prevent last-minute bidding, Gavel may extend the auction end time by up to 5 minutes if a bid is placed within the last 5 minutes of the auction. Subsequent bids during this extension will further extend the auction.
Reserve Price
Sellers may set a reserve price, indicating the minimum price at which they are willing to sell an item. If the reserve price is not met, the seller is not obligated to sell the item.
Buyer's Obligations
Upon winning an auction, the buyer is obligated to complete the transaction according to the terms specified in the auction listing. This encompasses promptly remitting the final bid price and any applicable fees within 24 hours from the conclusion of the auction. Additionally, the buyer will be responsible for covering the shipment fees from Gavel to their location.
Seller's Obligations
Sellers are responsible for providing accurate and comprehensive information about the item to Gavel, including its condition, specifications, and other relevant details. Gavel, acting as an intermediary, will verify the provided information before listing the item on the platform.
Shipping
With additional fees, Gavel may oversee the shipping process to ensure the item reaches the winning bidder in the condition described in the listing. Gavel's shipping procedures are designed to provide a seamless experience for buyers, ensuring the safe delivery of items.
Seller's Return Policy
If an item is returned for any reason, the responsibility for associated costs depends on the timing of the return:
- • If the item is returned after inspection, the seller will be responsible for the inspection and the shipping fees.
- • If the item is returned before inspection, the seller will be responsible for the shipping fees only.
Fees and Payments
Gavel's fees are as follows:
- • If the item is sold for a price below 30,000 AED, Gavel will charge a flat fee of 600 AED.
- • If the item is sold for a price of 30,000 AED or higher, Gavel will charge a fee of 2% of the final sale price. This fee will be deducted from the total selling price if the item is sold.
Prohibited Activities
Participants must abstain from engaging in any prohibited activities, as delineated in Gavel's Terms of Service. Violation of these conditions may result in account suspension or termination.
Governing Law
These Auction Conditions shall be governed by and construed in accordance with the laws of the Emirate of Dubai, United Arab Emirates, without regard to its conflict of laws principles.
